California doesn’t have a separate criminal charge called “extreme DUI” the way some other states do. VC 23578 is a sentencing enhancement applied on top of an underlying DUI conviction under VC 23152 or VC 23153. When a driver’s BAC registers at 0.15% or higher, or when they refused a breath or urine test, the statute instructs the court to treat that fact as a special factor when deciding penalties, probation terms, and whether to impose additional conditions.

A 0.15% BAC is nearly double the 0.08% legal limit. That gap matters to prosecutors and judges alike. An arrest at that level triggers two separate proceedings simultaneously: a criminal case handled by the Contra Costa County District Attorney and a DMV Administrative Per Se (APS) hearing to determine whether your license is suspended.
